Understanding Civil Restraining Orders In California

A large portion of our practice is focused on helping individuals who are being threatened, abused, harassed or stalked by someone. This sort of behavior can have a significant impact upon your life, and we want to make sure that we are taking all the steps necessary to prevent this from happening in the future.

We wanted to take a few moments to address some of the frequently asked questions that we receive at Synergy Law Group, Inc., concerning restraining orders in California. For more information, please contact one of our attorneys to help obtain immediate relief.

What Is A Restraining Order?

A restraining order is a means used by the courts to help protect people who are suffering from sexual abuse, physical abuse or harassment. These documents require the offending persons to stop the activities that they are engaged in or face significant consequences. In some cases, these orders may even require that certain individuals move out of a residence in order to ensure that the abused individual is safe from further acts of violence or harm. There may be temporary restraining orders that offer protection for a limited period of time, or permanent orders that prohibit the individual from ever engaging in these activities.

When Are Restraining Orders Available?

There are two types of restraining orders that we handle at Synergy Law Group, Inc. The first concerns acts involving intimate partners or family members. This could be a person who you were married to or had a sexual relationship with in the past, or a current spouse or romantic partner. We help those who need immediate relief due to an abusive or threatening situation.

The second type of restraining order that we handle are for non-domestic situations. These include scenarios where the individual threatening, stalking, abusing or harassing you is a co-worker, neighbor, a family less close family member or roommate.

What Does A Restraining Order Prevent?

The short answer to this is that it depends entirely on what is happening in your specific situation. For example, if your spouse has abused you, or abused your children, you may be able to obtain an order that requires him or her to leave the residence. If you are being threatened with harm by a co-worker, the behavior must stop, or the individual could face jail time or fines.

The important thing to remember is that there are many different options in place designed not only to end the dangerous behavior, but also to keep you safe from future harm. You must speak with an attorney who is experienced with the process so that the order you have put in place is actually sufficient to offer you the protection you need.
